Model Bar Disciplinary Action Ordinance

This model reporting ordinance for disciplinary actions against bar licensees is intended to assist Georgia cities in ensuring compliance with the 45-day notification requirement to the Georgia Department of Revenue. The ordinance stems from House Bill 152, passed during the 2015-2016 legislative session, which mandates that cities report disciplinary actions taken against licensees operating bars.

Cities that do not issue alcohol licenses to establishments deriving 75% or more of their annual gross revenue from on-premise alcohol sales are not required to enact such an ordinance. However, municipalities with these establishments must adopt a policy and implement a reporting process. Any text in bold italics is included for informational purposes only and is not part of the official ordinance.

The ordinance is designed for informational purposes only and should not be considered legal advice. Cities should consult legal counsel before drafting or adopting the ordinance or taking action based on this model.
