Model Municipal Court Prosecutor Ordinance

In 2012, Senate Bill 352 was enacted, introducing statutory provisions for prosecuting attorneys in Georgia's municipal courts. The law allows cities to establish an office of prosecuting attorney for their municipal court. If a city creates or already has a prosecuting attorney, it must notify the Prosecuting Attorneys' Council within 30 days of the office's establishment or the appointment of the attorney.

The prosecuting attorney must be a member of the State Bar of Georgia and admitted to practice before the state's appellate courts. This model ordinance and resolution provide cities with guidance on complying with these legal requirements.
