Sovereign Immunity; Declaratory and Injunctive Relief

This legislation would waive sovereign immunity of political subdivisions, including cities, as to any claim seeking declaratory and injunctive relief to remedy an injury, including an imminent threat of injury, by the political subdivision acting without lawful authority or in violation of the U.S. Constitution, Georgia Constitution, state law, state rules or regulations, or a local ordinance (excluding zoning ordinances). Sovereign immunity is also waived to actions ex contractu for the breach of any written contract. The legislation provides that no suit can be commenced without first providing a 30 day ante litem notice.
