EMCs and Broadband Delivery

This legislation provides statutory authority to electric membership corporations (EMCs) to provide broadband services, while prohibiting the cross-subsidization between various affiliate services within an EMC, such as electric, broadband or gas.
Additionally, this bill would allow an electric membership corporation (EMC) with an existing electric easement to use that same easement for the purposes of deploying broadband services, as long as no additional poles are installed or any other ground-mounted facilities that would affect the property owner adversely. Additionally, the electric owner of the easement would be allowed to charge reasonable rates and fees for the usage of the facilities granted by the electric easement.
